YUP AS RECOGNISED APPLICANTS

On 7 April 2017, a native title determination application (or “claim”) was filed in the Federal Court of Australia on behalf of the Yuggera Ugarapul People (“YUP”), under the legal framework of the Native Title Act 1993 (Cth).

The QUD213/2017 YUP claim was accepted for registration by the National Native Title Tribunal (NNTT) on 4 August 2017, and has remained on the Register of Native Title Claims since then.

NATIVE TITLE CLAIM GROUP RIGHTS

If a claim satisfies the registration test, it will be registered on the Register of Native Title Claims and the claim group gains certain rights in relation to their claim area. For example, these rights include:

  • Procedural rights in relation to “future acts”, which are certain acts in relation to land and waters that affect native title; and
  • Rights in relation to the protection of Aboriginal or Torres Strait Islander cultural heritage.

Generally, these rights are exercised by the Applicant who act on behalf of the claim group and with their authority. This means that the Applicant is a key point of contact for the claim group, and also for people who want to engage with them.
